MANUAL IN TERMS SECTION 51 OF THE PROMOTION
OF ACCESS TO INFORMATION ACT
(herein after referred to as the Act)
1. INTRODUCTION:
The promotion of Access to information Act No.2
of 2000, gives effect to the Constitutional right of access to
any information held by the State and any information that is
held by another person and that is required for the exercise or
protection of any right. Where the request is made in terms of
the Act, the body to which the request is made, is obliged to
release the information, except where the Act expressly provides
that the information may not be released. The Act sets out the
requisite procedures associated with any such request.
Section 9 of the Act recognises that the exercise
of such information rights can be limited, and should be subject
to limitations where it poses a threat to the protection of privacy,
commercial confidentiality, and the exercising of efficient governance.

4. RECORDS THAT ARE AVAILABLE WITHOUT REQUESTING ACCESS
IN TERMS OF THIS ACT:
6. HOW TO REQUEST ACCESS TO RECORDS HELD
BY OBP:
Requests for access to records held by OBP must
be made on the request forms (on payment of the prescribed fees),
that are available from the South African Human Rights Commission’s
website (www.sahrc.org.za) or the Department of Justice and Constitutional
Development (www.doj.gov.za - under “regulations”).
Requests for access to records must be made to our
Information Officer at the address, fax number or e-mail address
indicated above.
The requester must provide sufficient detail on
the request form to enable the Information Officer to identify
the record and the requester. The requester must further identify
the right that he or she is seeking to exercise or protect, and
provide an explanation of why the requested record is required
to exercise or protect that right.
If a request is made on behalf of a person, the
requester must then submit proof, to the satisfaction of the Head,
of the capacity in which the requester is making the request.
7. AVAILABILITY OF THE MANUAL:
In addition to availability of this Manual at the
South African Human Rights Commission, it could also be obtained
from our website or copies may also be obtained from the Information
Officer. The postage of hard copies will be for the account of
the requester.
